Uponor is one of the world’s largest manufacturers of polyethylene plastic pipe which supplies potable water to residential properties. The proposed class action seeks to represent thousands of California residents in which the Uponor pipe is installed.
The Complaints allege that the Uponor red, white, and blue PEX pipe suffers from multiple defects, including oxidative degradation. The life expectancy of the pipe is 50-100 years. The pipe typically fails within three to 10 years after installation. The defects are progressive in nature, and the pipe continues to crack and leak. The resulting property damage is often substantial and expensive. The Complaints allege that all of the Uponor pipe must be removed and replaced because there is no way to stop future failures.
The Complaints allege that Uponor has “long been aware” of the oxidative degradation issue with its piping systems. Despite this knowledge, the Complaints allege that Uponor has intentionally failed to disclose the defects to consumers, distributors, contractors, installers or building officials.
The Complaints make clear that the failures in the Uponor pipe are caused exclusively by the defective manufacturing process and cannot be attributed to faulty installation or water temperature or water pressure in the system: “Poor installation practices cannot cause these defects in the class pipe and perfect installation practices will not prevent them.”
The lawsuits seek to represent all individuals and entities who own single-family residential property in California in which Uponor pipe manufactured and installed from 2010 to the present.
